WHAT DO I NEED TO PREPARE?

Smart-Check is a set of a few quick questions: based on your answers we assess whether there is a risk of illegal work or illegal residence.Expert-Check is a comprehensive review of documents. We need your passport (all pages) and your Karta Pobytu — or, if you do not have one, the application, confirmation of its submission, and official letters concerning your stay. People with UKR status: a screenshot from the Diia app. Also send any other documents on the matter that you consider relevant.Regarding employment, we need your contract, proof of salary payment (from your bank), and answers to a few questions.

IS IT SAFE?

Yes. All documents are sent and stored securely. We use encryption, secured servers, and limited data access. Only people involved in the analysis have access to the documents. We do not store data longer than necessary, and it is deleted after the process is complete.

HOW LONG DOES THE DOCUMENT ANALYSIS TAKE?

The time depends on the service you choose.Smart-Check: you will receive the result within 48 hours of submitting the questionnaire.Expert-Check: the report is prepared by an expert — this normally takes up to 72 hours from the moment you send the complete set of documents.
If anything is missing, we will contact you to complete the materials.

WHAT IS THE DIFFERENCE BETWEEN SMART-CHECK AND EXPERT-CHECK?

  • Smart-Check — a quick automated check based on the information you provide. We do not analyse documents.

  • Expert-Check — analysis of your documents by an expert and a compliance report.

IS THE ANALYSIS A LEGAL SERVICE?

No. Safe-Check does not provide legal services within the meaning of the law. The analysis is informative and helps you determine whether your documents and terms of employment look correct. If we detect irregularities, you will receive recommendations in the report on what to do next or where to seek help.

CAN I CHECK SOMEONE ELSE'S DOCUMENTS?

Yes — provided you have that person’s consent. Safe-Check can only analyse documents of people who have consented to this or who submit the documents themselves. If you act as an authorised representative or guardian, remember to have proof of authorisation.

WHAT IF MY EMPLOYER DOESN'T WANT TO SHOW ME DOCUMENTS OR THE CONTRACT?

You have the right to receive a copy of the documents on the basis of which you work. If the employer refuses, Safe-Check can help you assess which documents you should have and whether the situation looks suspicious. In the report, you will receive information on what steps you can take to recover the documents or verify their content.

I SUSPECT MY EMPLOYER IS UNDERPAYING ME – CAN THIS BE DETECTED?

Yes. Based on your contract, rates, bank statements and applicable regulations, we can check whether your remuneration has been calculated correctly. In the report, you will receive clear information: – whether the rate is correct, – whether you should receive more, – whether the employer applies the correct settlement rules.

WHAT IF MY RESIDENCE OR WORK MAY TURN OUT TO BE ILLEGAL?

You don't have to worry – the analysis is confidential, and no one but you will know the result. In the report, you will receive information on exactly what is wrong and what your options are. You will also get tips on where you can get support or how to fix the situation step by step.

CAN SAFE-CHECK HELP ME IF MY EMPLOYER THREATENS ME (E.G., “YOUR WORK IS ILLEGAL”)?

Yes. Employers sometimes use such words to create pressure – but very often their claims are untrue. Safe-Check will allow you to check whether there is actually any problem. In the report, you will receive a clear assessment of the documents and a calm, factual explanation that you can use in conversation with the employer.

§ 1. General Provisions1. These Terms of Service set out the rules for using the website available at www.safe-check.eu, hereinafter referred to as the "Service."
2. The owner and administrator of the Service is NextVenture Sp. z o.o., with its registered office in Szczecin, Poland, at ul. Uczniowska 4b, entered in the register of entrepreneurs of the National Court Register (KRS) under number: 0001193507, NIP (tax ID): 9552590814, REGON: 542690864, hereinafter referred to as the "Service Provider."
3. Contact with the Service Provider for all matters is available at: [email protected]. Submissions containing documents, as well as complaints, should be sent to: [email protected].
§ 2. Definitions1. Client/User — a natural person who uses the Services provided by the Service.
2. Service — one of the services described in § 3, provided by the Service Provider through the Service.
3. Report — a PDF document sent electronically, containing the result of the analysis carried out under the Smart-Check or Expert-Check Service with regard to compliance with the requirements for legal employment and residence in Poland.
4. Form — an interactive form available on the Tally.so platform, used to submit data and, in the case of Expert-Check, documents. As part of the ordering process for a paid Service, the Client is redirected to an external payment operator to complete payment.
§ 3. Type and Scope of Services1. The Service Provider offers three variants of Services:
- a) Smart-Check — a free, preliminary assessment of the risk of illegal employment or illegal residence, prepared solely on the basis of the answers provided by the Client in the questionnaire. The Service does not include verification of any documents or external registers.
- b) Doprecyzowanie ("Follow-up Question") — a paid service consisting of an answer, given by the Service Provider's analyst, to one specific question asked by the Client after receiving the Smart-Check Report. The Service does not include analysis of additional documents. The amount paid for this Service may be credited toward the price of Expert-Check, under the terms communicated to the Client at the time of purchase.
- c) Expert-Check — a paid service consisting of a detailed audit of the documents submitted by the Client, in particular comparing their content against each other (including work permits, contracts, proof of salary payments, and Social Insurance Institution (ZUS) registration) and identifying any discrepancies, carried out by the Service Provider's analyst.
2. Limitation of Liability (Important): The Services provided through the Service are exclusively informational and educational in nature. Neither the Report nor the answer provided under the Doprecyzowanie Service constitutes legal advice or a legal opinion within the meaning of the Act on Legal Counsel, nor does it guarantee obtaining any administrative decision (e.g., a Karta Pobytu — residence card).
3. The Service Provider is not liable for legal consequences resulting from the use of the Report before public authorities or courts, nor for the actions of the Client's employers or employment agencies.
4. If the Client's answers indicate a situation of immediate risk to personal safety (in particular, confiscation of an identity document by an employer or intermediary), the Service does not present the Client with any paid offer, and instead directs the Client to safety information available at safe-check.eu/#besafe (or the corresponding language version of the domain).
§ 4. Ordering and Payment1. Using the free Smart-Check Service only requires filling out the Form and accepting these Terms of Service and the Privacy Policy.
2. Using the Doprecyzowanie or Expert-Check Service requires:
- a) filling out the relevant Form and making payment in advance via Stripe — in the order applicable to the given Service, as indicated on the Service website,
- b) accepting these Terms of Service and the Privacy Policy,
- c) submitting the separate statements referred to in § 6(2).
3. The contract for the provision of a paid Service is concluded at the moment the Client successfully completes payment.
4. Prices of the Services shown on the Service website are gross (VAT-inclusive) prices. Sales are settled collectively; the Service Provider issues a VAT invoice at the Client's individual request, sent to [email protected] no later than within 3 months, counted from the end of the month in which the sale took place.
§ 5. Service Completion1. Completion time is counted in business days and amounts to:
- a) Smart-Check — a preliminary result immediately after the Form is submitted; the PDF Report within 48 hours,
- b) Doprecyzowanie — within 24 hours of payment being posted,
- c) Expert-Check — within 72 hours of receiving a complete set of legible documents and payment being posted.
2. The Report or the answer provided under Doprecyzowanie is sent to the e-mail address given in the Form.
3. If the Client submits illegible or incomplete documents, the Expert-Check completion time may be extended until correct files are provided; the Service Provider will notify the Client promptly.
§ 6. Withdrawal from the Contract1. In accordance with Art. 38 of the Act of 30 May 2014 on Consumer Rights, the right to withdraw from a distance contract does not apply to contracts for the supply of digital content not delivered on a tangible medium, if performance began with the Client's express, prior consent before the withdrawal period expired, and the Client was informed of the resulting loss of that right.
2. Before making payment for Doprecyzowanie or Expert-Check, the Client makes two separate statements:
- a) expressly consenting to the Service Provider beginning performance of the Service before the expiry of the 14-day withdrawal period; and
- b) acknowledging that giving this consent results in the loss of the right to withdraw from the contract once the Service has been fully performed by the Service Provider.
3. Without both statements referred to in paragraph 2, the Service Provider will not begin performance of a paid Service.
§ 7. Complaints1. Complaints regarding the Service may be submitted to: [email protected].
2. The Service Provider will review the complaint within 14 days.
3. The fact that the verification result (the Report or the answer given under Doprecyzowanie) is unfavourable to the Client (e.g., detection of signals indicating illegal employment) cannot be grounds for a complaint.
§ 8. Personal Data1. The controller of personal data is NextVenture Sp. z o.o., with its registered office in Szczecin, Poland.
2. As part of the Expert-Check Service, the Client provides the Service Provider with scans or photographs of documents necessary to perform the Service. These documents are processed solely for the purpose of performing the Service.
3. Detailed rules on the processing of personal data, including purposes, legal bases, retention periods, and the rights available to the Client, are described in the Privacy Policy available on the Service website.
§ 9. Final Provisions1. These Terms of Service are available in Polish and in translation into English, Ukrainian, and Russian. In the event of any discrepancy between language versions, the Polish version shall prevail.
2. Matters not regulated by these Terms of Service are governed by Polish law, in particular the Polish Civil Code and the Act on Consumer Rights.
3. The Service Provider reserves the right to amend these Terms of Service. Amendments do not affect contracts concluded before they take effect.

We process the data you provide in the questionnaire: name, e-mail address, and answers concerning your employment and residence situation. The Smart-Check questionnaire does not require you to submit any documents. Legal basis: Art. 6(1)(b) GDPR (steps taken at your request prior to entering into a contract / performance of a contract for a service).b) Doprecyzowanie and Expert-Check (paid services). We additionally process the content of the question asked (Doprecyzowanie) and the scans or photographs of documents you provide for the purpose of verification under Expert-Check — in particular your residence document, work permit, employment contract, proof of salary payments, and Social Insurance Institution (ZUS) documents. Legal basis: Art. 6(1)(b) GDPR (performance of a contract) and, with regard to invoicing, Art. 6(1)(c) GDPR (legal obligation).c) Employer or employment agency name. If you provide the name of your employer or agency in the questionnaire, we use this information solely internally — to build our own picture of the market and identify entities against which risk signals have been reported. This information is not used for marketing purposes or to acquire new business clients, is never included in any published or sold report, and is never, under any circumstances, used as a basis for contacting your employer or agency. We keep an internal register of these entities separately from your personal data — the link exists only at the level of the individual submission, not the person. Legal basis: Art. 6(1)(f) GDPR (the Controller's legitimate interest in assessing the risk of dealing with labour-market entities).3. Automated assessment in Smart-CheckThe preliminary Smart-Check result (status: OK / Needs checking / Urgent) is determined automatically, by applying a set of rules to your questionnaire answers, without human involvement at this stage. The result is purely informational, does not by itself produce any legal effect concerning you, and is not binding. You may always request an assessment carried out by a human as part of the Expert-Check service.4. Who we share data withWe share your data only with entities necessary for the operation of the Service, under agreements concluded with them:- Tally — the form provider, and the place where your questionnaire answers are stored.
- Stripe — the payment operator, processing data necessary to complete transactions.
- Analysts cooperating with the Controller who perform the Expert-Check service, bound by confidentiality agreements.
We do not share your data with your employer, your employment agency, or any public authority — this is one of the fundamental principles behind how Safe-Check operates. Some data recipients are located outside the European Economic Area; in such cases, data transfers are based on standard contractual clauses approved by the European Commission, or another mechanism provided for under the GDPR.5. How long we retain data- Documents submitted for Expert-Check (scans, photographs): permanently deleted from our servers within 30 days of completing the service.
- Expert-Check submissions for which payment was not made: documents and data are deleted within 14 days of submission if payment is not completed.
- Smart-Check questionnaire answers and the generated Report: retained for 12 months from service completion, for the purpose of handling any complaints, and then deleted or anonymised.
- Billing data (invoices): retained for 5 years, counted from the end of the tax year in which the invoice was issued (a tax-law requirement).
- The internal register of entities (§ 2c): retained without any link to your personal data.
6. Your rightsYou have the right to: access your data, have it rectified, have it deleted ("the right to be forgotten"), restrict its processing, data portability, and object to processing based on Art. 6(1)(f) GDPR. To exercise these rights, write to [email protected]. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO), Poland's data protection authority.7. SecurityWe use connection encryption (SSL/TLS) and technical and organisational security measures to protect your data and documents from unauthorised access.8. CookiesThe safe-check.eu website does not currently use its own cookies for analytics, marketing, or tracking purposes. The Tally forms and Stripe payment pages to which the Service redirects you may set their own cookies necessary for their operation (e.g., fraud prevention), in accordance with those providers' own privacy policies. If the Service Provider introduces its own analytics or marketing tools using cookies in the future, this section will be updated before they are enabled, and the Client will be informed.9. Language versionsThis Policy is available in Polish and in translation into English, Ukrainian, and Russian. In the event of any discrepancy between language versions, the Polish version shall prevail.This English version is a translation of the binding Polish original and has not yet been verified by a native-speaking legal reviewer. In case of any discrepancy, the Polish version prevails (see § 9).

You don't need to give your details just to ask for help.
Your passport or other ID document is your property. Having it withheld by an employer or intermediary — even "for safekeeping" or "to complete paperwork" — is unlawful in Poland, regardless of what was promised verbally.What you can do1. Demand the return of your document. Ask for your passport back in the presence of witnesses, if it's safe to do so. Take a photo or scan of the document beforehand if
you're able to. Send the request in writing — by text message, e-mail, or messaging app — to have proof, and keep all correspondence.
2. Report it to the Police or Border Guard. In an emergency, call 112. You can also go in person to the nearest police station or Border Guard post and report the theft or unlawful withholding of your document — these services have the authority to enter company
premises and retrieve your passport.
3. Contact the National Intervention and Consultation Centre (KCIK). KCIK helps victims of human trafficking and forced labour in Poland — offering legal and psychological support, safe shelter, and help recovering documents. Phone: +48 22 628 01 20.4.
